1. Acceptance of Terms

By creating an account, browsing, or using Maseiro, you agree to these Terms of Service, our Privacy Policy, and any additional guidelines posted on the platform. If you do not agree, please do not use our services.

2. Account Registration

To access certain features of the platform, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these terms.

3. Platform Description

Maseiro is a SaaS platform that enables professional photographers to create and manage photo galleries, showcase their work, and sell physical products such as prints and merchandise. The platform provides gallery hosting, product mockup generation, e-commerce functionality, and Progressive Web App (PWA) gallery experiences.

4. Subscriptions and Payments

• All payments are processed securely through Stripe
• Prices are displayed in EUR (European Euro)
• Subscription plans are billed on a monthly basis
• A free trial period may be offered for new subscribers (minimum 48 hours)
• By subscribing, you agree to pay the listed price plus any applicable taxes
• You can manage your subscription and billing details through the Stripe billing portal
• Subscriptions can be cancelled at any time; access continues until the end of the billing period

5. Photographer Accounts

If you subscribe as a photographer on Maseiro:

• You gain access to create and manage photo galleries and collections
• You can upload media, organize folders, and customize your public profile (logo, favicon, company name, social media links)
• Your public galleries are accessible at your unique artist URL
• You can create and sell physical products with auto-generated mockups
• You are responsible for the content you upload and the accuracy of your product descriptions
• You retain full ownership of your uploaded photos and media
• Your galleries are publicly visible only while your subscription is active

6. Product Purchases

• Customers can browse and purchase physical products (prints, merchandise) from photographers
• All product payments are processed through Stripe checkout
• Customers must provide valid shipping and billing information
• Orders are tracked and managed through the platform
• Product availability and pricing are set by individual photographers

7. Refund Policy

Refund requests for product purchases are handled on a case-by-case basis. You may request a refund if:

• The product received is significantly different from the mockup or description
• The product arrives damaged or defective
• The order was not delivered within a reasonable timeframe

8. Prohibited Content

You may not upload or publish content that:

• Infringes on intellectual property rights of third parties
• Contains illegal, offensive, or harmful material
• Violates any applicable laws or regulations
• Misrepresents authorship or ownership of photographs
• Contains malicious code or security vulnerabilities

We reserve the right to remove any content and suspend the associated account without notice.

9. Intellectual Property

• Photographers retain full ownership of their original photos and media
• Customers receive physical products but do not acquire reproduction rights to the photographs
• The Maseiro brand, logo, and platform design are our exclusive property
• You may not reproduce, modify, or distribute our platform content without written permission

10. Limitation of Liability

Maseiro is provided "as is" without warranties of any kind. We are not liable for:

• Any indirect, incidental, or consequential damages
• Loss of data, profits, or business opportunities
• Issues arising from products sold by photographers on the platform
• Service interruptions or technical difficulties
• Loss or corruption of uploaded media files (photographers should maintain their own backups)

Our total liability shall not exceed the amount you paid for your subscription or the specific product in question.

11. Account Termination

We may suspend or terminate your account at any time if you:

• Violate these Terms of Service
• Engage in fraudulent or abusive behavior
• Upload prohibited content
• Attempt to circumvent platform security measures

Upon termination, your galleries will no longer be publicly accessible. You may request export of your data before termination takes effect.

12. Changes to Terms

We may update these Terms of Service from time to time. We will notify users of significant changes via email or platform notification. Continued use of the platform after changes constitutes acceptance of the updated terms.

13. Governing Law

These terms are governed by and construed in accordance with the laws of Romania. Any disputes shall be resolved in the competent courts of Romania.
